Terms and Conditions of Reservation
1. Scope of Agreement
These Terms and Conditions ("Terms") govern the reservation of the Fourier Sound Inc. high-fidelity audio system (the "System"), comprising four (4) loudspeakers and twenty-eight (28) channels of DSP-controlled amplification. By placing a Reservation Deposit, you ("Customer") agree to these Terms.
2. Reservation Deposit
Amount: A deposit of $5,000 ("Deposit") is required to secure a production slot.
Introductory Pricing: This Deposit locks in the AXPONA introductory price of $50,000 (plus applicable taxes and shipping), regardless of future MSRP increases.
Application of Funds: The Deposit will be applied in full toward the final purchase price of the System.
3. Founders Series vs. Production Queue
Founders Series: The first ten (10) reservations are designated as the "Founders Series." These units include exclusive serialization and priority production.
General Production: Reservations placed after the Founders Series has reached capacity will be placed in the secondary production queue in the order received.
4. Production Timeline & Communication
Estimated Lead Times: Due to the bespoke nature of our 28-channel systems, lead times are estimates and not guarantees.
The 6-Month Protocol: If Fourier Sound Inc projects that the time from Deposit to system completion will exceed six (6) months, we will contact the Customer directly. At this juncture, the Customer may choose to remain in the production queue or request a full refund of the Deposit.
Progress Updates: Customers will receive periodic updates regarding the manufacturing status of their specific build.
5. Refund & Cancellation Policy
72-Hour "Grace Period": Deposits are 100% refundable if a cancellation request is received in writing within 72 hours of the initial transaction.
Commitment of Resources: After the 72-hour grace period, the Deposit becomes non-refundable, except as provided in the "6-Month Protocol" (Section 4). This reflects the immediate allocation of specialized components and engineering resources required for your build.
Non-Transferability: Reservations and deposits are tied to the original Customer and are not transferable to other parties or third-party purchasers.
6. Final Sale & Delivery
Purchase Agreement: Prior to the commencement of your specific build, a formal Purchase Agreement will be issued detailing final specifications, finish selections, and shipping logistics.
Balance Due: The remaining balance must be paid in full according to the terms outlined in the final Purchase Agreement before the System departs our facility.
Shipping & Installation: Shipping costs, duties, and professional on-site calibration fees (if requested) are the responsibility of the Customer unless otherwise stated in writing.
7. Limitation of Liability
Fourier Sound Inc. shall not be held liable for delays caused by global supply chain disruptions, component shortages, or other factors beyond our reasonable control. Our maximum liability to the Customer is limited to the total amount of the Deposit paid.
